Harry Clarke & Sons Ltd (“HCS”, “we”, “us” or “our”) is strongly committed to protecting personal data. We take your privacy very seriously and we ask that you read this Privacy Notice carefully as it contains important information on who we are, how and why we collect, store, use and share personal information, your rights in relation to your personal information and on how to contact us and supervisory authorities in the event you have a complaint.

Personal data is any information relating to an identified or identifiable living person. HCS processes personal data for a number of purposes, and the means of collection, lawful basis of processing, use, disclosure, and retention periods for each purpose may differ.

Who we are

HCS collects, uses and is responsible for certain personal information about you. When we do so we are regulated under the General Data Protection Regulation (GDPR) 2018 which applies across the European Union (including in the United Kingdom) and we are responsible as ‘controller’ of that personal information for the purposes of those laws.

 

The personal information we collect and use

In the course of performance of our business functions we collect the following personal information when you provide it to us:

  1. Employees

We collect personal data concerning our employees as part of the administration, management and promotion of our business activities. We hold information about employees of HCS to enable us to employ, pay and manage their work. We may also hold information about a next of kin in case of emergencies.

While you work with HCS we will keep information about your attendance. This is also used to keep you safe in case of fire. We hold information about your recruitment, about training and development, and about your performance. We may keep information about disciplinary proceedings.

This information is not normally disclosed to anyone except Human Resources and Department Managers.

In case of a dispute, or for legal purposes, we may need to disclose this information to the authorities or to other legal professionals.

The legal basis for processing your data is ‘contract’ whilst you are an employee, sometimes ‘legal requirement’ in case of certain records, such as payroll.

Where we hold next of kin information, it is on the basis of ‘consent’.

  1. Recruitment applicants

When applying for a role at HCS, applicants should refer to the information made available about why and how personal data is collected and processed.

  1. Suppliers and Subcontractors (including subcontractors and individuals associated with our suppliers and subcontractors)

We collect and process data about our suppliers (including subcontractors and individuals associated with our suppliers and subcontractors) in order to manage the relationship, manage the contract, to receive services from our suppliers and, where relevant, to provide professional services to our customers.

The personal information we hold is your name, job title, telephone number and maybe your work email address.

We use personal data for the following purposes:

  • Receiving services
  • Providing professional services
  • Administering, managing and developing our businesses and services
  • Security, quality and risk management activities
  • Providing our suppliers with information about us and our services
  • Complying with relevant law and regulations

The legal basis for processing your data is ‘contract’ while you are a supplier. When you are no longer an active supplier, it is ‘legitimate interest’ because we may want to order from you again.

  1. Customers (and individuals associated with our customers)

HCS collects only the personal data necessary for agreed purposes and we ask our customers to only share personal data where it is strictly needed for those purposes.

The personal information we hold is your name, address, job title, email address and telephone number. We do not store credit card details.

We use personal data for the following purposes:

  • Providing professional services
  • Administering, managing and developing our businesses and services
  • Security, quality and risk management activities
  • Providing our customers with information about us and our services
  • Complying with relevant law and regulations

Visitors to our website are generally in control of the data shared with us. We may collect, store and use the following kinds of data:

  • require the erasure of personal information concerning you in certain situations

  • object at any time to processing of personal information concerning you for direct marketing
  • object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you
  • object in certain other situations to our continued processing of your personal information
  • otherwise restrict our processing of your personal information in certain circumstances

Keeping your personal information secure

We have appropriate security measures in place to prevent personal information from being accidentally lost, or used or accessed in an unauthorised way. We limit access to your personal information to those who have a genuine business need to know it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.

We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

We hope that you won’t ever need to, but if you do want to complain about our use of personal data, please contact the Data Protection Officer with the details of your complaint. We will look into and respond to any complaints we receive.
